Why IP Law Matters For A Fashion Student

Remember the iconic cerulean blue sweater scene from The Devil Wears Prada? It offers instructive lessons on the workings of the fashion industry.

Bisman Kaur, Of Counsel at Remfry & Sagar, used this example to show how IP shapes fashion when she recently spoke to students at the National Institute of Fashion Technology, Delhi.

The session drew on real-world controversies involving luxury brands, fashion dupes, counterfeiting, cultural appropriation versus appreciation, geographical indications (GIs) and traditional craftsmanship. Discussions also touched on resale, the circular fashion economy and the emerging challenges posed by AI-generated designs.

For tomorrow's fashion professionals, understanding IP is not just about protecting what they create. It is also about knowing what they can borrow, adapt and build upon.
