Geographical Indications

Since 2003 when India implemented the law on geographical indications (GIs) to fulfill its obligations under the TRIPS (Trade Related Aspects of Intellectual Property Rights) Agreement, we have filed several applications to register GI rights for domestic and international companies including prominent wine and cheese makers. Our GI practice covers:

 

  • Counseling, support and strategy on the registrability of geographical indications;
  • Preparing and filing applications for registration of geographical indications; attending to objections raised upon examination; conducting oppositions and cancellation actions in the GI domain; handling renewal of geographical indication registrations; and representing clients before the Geographical Indications Registry and the Intellectual Property Appellate Board (IPAB) in proceedings related to the aforesaid activities;
  • Strong capabilities in enforcing GI rights including litigating suits of infringement and passing-off before various courts across India;
  • Assisting clients with the protection and registration of GI rights in outside jurisdictions through our network of associates.
